1. Agreement to Terms

By downloading, installing, accessing, or using the SmartHour mobile application (the "App"), website (www.smarthour.app), or services (collectively, the "Service"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, you may not use the Service.

SmartHour ("Company," "we," "us," "our") provides an electricity price monitoring application for tracking real-time Nordic Power Exchange (NordPool) electricity prices and receiving personalized recommendations for saving on energy costs.

These Terms constitute a legally binding agreement between you and SmartHour. By using the Service, you acknowledge that you have read, understood, and agree to be bound by all provisions of these Terms.

2. Use of Service

Subject to your compliance with these Terms, SmartHour grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes. This license does not permit you to:

When creating an account, you must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your password and account information. You agree to notify us immediately of any unauthorized use of your account.

3.2 Your Responsibility

You are solely responsible for all activity that occurs under your account, whether or not authorized by you. You agree to immediately notify SmartHour of any unauthorized access or use of your account.

3.3 Account Termination

You may terminate your account at any time by contacting us or using the account deletion feature in the App. Upon termination, your data will be deleted according to our Data Retention Policy (see our Privacy Policy).

4. Prohibited Conduct

You agree not to use the Service for any unlawful purpose or in violation of these Terms. Prohibited conduct includes, but is not limited to:

SmartHour reserves the right to investigate and prosecute violations of these Terms to the fullest extent permitted by law. We may permanently ban users who violate these Terms.

5. Intellectual Property Rights

5.1 Company-Owned Content

All content in the Service—including text, graphics, logos, images, audio, video, code, and software—is the exclusive property of SmartHour or its content providers and is protected by copyright, trademark, and other intellectual property laws.

5.2 Limited Use License

You may view, download, and print content from the Service for personal, non-commercial use only. You may not reproduce, distribute, or display content without our express written permission.

5.3 Trademarks

SmartHour, the SmartHour logo, and all associated trademarks are the property of SmartHour. You may not use our trademarks without our express written consent.

5.4 User-Generated Content

If you submit feedback, suggestions, or other content to SmartHour, you grant us a worldwide, royalty-free, perpetual license to use such content for improving the Service, subject to our Privacy Policy.

6. Premium Features and Subscriptions

6.1 Premium Subscription

SmartHour offers optional premium features available via paid subscription. Premium features provide enhanced functionality and advanced recommendations.

6.2 Pricing and Billing

6.3 Free Trial

If a free trial is offered, it is available to new customers only. Free trial access will be converted to paid subscription unless canceled before the trial period ends.

6.4 Cancellation

You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of your current billing cycle.

6.5 No Refunds

Except as required by applicable law, subscription fees are non-refundable. If you cancel mid-cycle, you will not receive a refund for the current billing period.

6.6 Changes to Premium Features

SmartHour may modify premium features at any time with 30 days' notice. If material changes significantly diminish premium value, you may cancel without penalty.

7. Limitation of Liability

7.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, SMARTHOUR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT.

7.2 Limitation of Damages

TO THE FULLEST EXTENT PERMITTED BY LAW, SMARTHOUR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7.3 Cap on Liability

IN NO EVENT SHALL SMARTHOUR'S TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM THE SERVICE EXCEED THE AMOUNT YOU PAID TO SMARTHOUR IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

7.4 Applicable to Authorized Partners Only

These limitations do not apply to damages for gross negligence, willful misconduct, or violations of applicable data protection laws.

8. Disclaimers

8.1 Price Information Accuracy

SmartHour provides electricity price data from NordPool, a public market data source. While we strive for accuracy, we do not guarantee that all price information is accurate, complete, or timely. Market prices may change rapidly, and the App may not always reflect real-time prices.

Warning: Do not make electricity usage decisions solely based on SmartHour recommendations without considering your specific situation, safety, and appliance requirements.

8.2 Energy Savings Not Guaranteed

SmartHour provides recommendations to help you save on electricity costs. However, actual savings depend on factors outside our control, including your electricity consumption patterns, appliance capabilities, and market conditions. We do not guarantee specific energy savings or bill reductions.

8.3 No Professional Advice

SmartHour is not a substitute for professional financial, legal, or energy advice. For important decisions, consult qualified professionals in your jurisdiction.

8.4 Third-Party Services

The Service may integrate with third-party services (NordPool, Firebase, etc.). We are not responsible for third-party services, their accuracy, or their availability. Your use of third-party services is governed by their terms and policies.

8.5 Network Interruptions

SmartHour is subject to network interruptions, technical issues, and maintenance. We do not guarantee uninterrupted access to the Service.

9. Indemnification

You agree to defend, indemnify, and hold harmless SmartHour, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney's fees) arising from:

10.1 Termination by You

You may terminate your account at any time by contacting support or deleting your account within the App.

SmartHour may terminate or suspend your account and access to the Service, with or without cause and with or without notice, including if you:

Upon termination, your license to use the Service ends, and you must delete the App from your device. Sections that should survive termination (limitations of liability, indemnification, etc.) remain in effect.

If you have a dispute with SmartHour, please contact us first to attempt informal resolution. If the dispute cannot be resolved informally, either party may pursue formal legal remedies available under applicable law.

These Terms are governed by the laws of Finland, without regard to conflicts of law principles. You consent to the jurisdiction of Finnish courts for any disputes arising from these Terms.

12.4 EU Users

If you are located in the European Union, you may pursue disputes through your national consumer protection authorities or European alternative dispute resolution mechanisms.

12.5 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and SmartHour regarding the Service and supersede all prior agreements and understandings.

Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

Waiver

SmartHour's failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
